At the end of last year, lawyers Ybo Buruma and Frans Sijbers wrote an article in the Tijdschrift voor Sanctionrecht & Onderneming, in which they argue for disciplinary law for civil servants as a solution to the enforcement deficit among enforcers and supervisors. The ACLPA is organizing an online seminar on 15 March where we will discuss their article.

The reason for the article was the Child Benefit Allowances (Toeslagenaffaire) affair. Lawyers Ybo Buruma and Frans Sijbers (Wladimiroff Advocaten) have looked into the (legal) options available to 'wrong' officials - officials who talk about 'package day', discriminate on the basis of the applicant's nationality, or deliberately fail to submit evidence to the court. provided . In their view, current possibilities for correction within criminal law and (punitive) administrative law are inadequate. They therefore argue for the (re)introduction of civil servants' disciplinary law as a possible solution to this enforcement deficit among enforcers and supervisors.

In addition to the two lawyers, Peter van Lochem acts as a referee:

mr. Dr. Peter van Lochem holds a PhD in lawyer and sociologist. Until May 2014, he was rector and director of the Academy of Legislation and of the Academy of Public Lawyers. In recent years, he has also been a member of various supervisory committees, including investigations into fireworks at the turn of the year (SMV), into hyperdynamic decision-making (Ministry of the Interior and Kingdom Relations) and into the Turkish Airlines plane accident (Investigation Council for Safety). He was also recently a member of the Safety Board Evaluation Committee.

Gerrit Jan Pulles will moderate during the event:

mr. Gerrit Jan Pulles is a practicing lawyer in Amsterdam and has taught at the UvA since 2006. As a lawyer he specializes in human rights law, disciplinary law and practical and professional ethics. His areas of expertise include (international) health law, disability law, social and economic rights and international child rights. Gerrit Jan holds law degrees from the Universities of Utrecht, Amsterdam and Oxford.
